Outside General Counsel

Most transportation and logistics companies do not have a lawyer on staff, and the ones that do have one person covering everything. Faino Law serves as outside general counsel for those companies: a standing relationship, a known number, and a lawyer who already knows the business when the question comes in.

Ben Faino held the general counsel seat at XPO Last Mile. He knows what leadership needs from the role: fast answers, a running list of what is open, contracts that get done without a project, and someone who owns the claims and litigation so the operators do not have to.

Services

What the relationship covers

  • A standing weekly call with leadership and a running list of open matters
  • Recurring contracts: customers, carriers, vendors, leases and employment
  • HR, safety and compliance program support
  • Claims management and insurer coordination
  • Litigation strategy and coordination with local counsel
  • Regulatory questions as they arise: FMCSA, state labor agencies, licensing

How it works

The arrangement is a fixed monthly fee or hourly billing, whichever fits the company, set out in a short engagement letter. Every open matter lives in FLIS, where leadership can see status, documents, the next move and what is waiting on whom, without asking.

Companies typically start with one matter and move to the standing relationship once the first one is handled. Either path begins with a consultation.
